INTRODUCTION

Depart Right Ltd., operating as DepartRight™, and our affiliates, subsidiaries, employees, and contractors ("Company"or "We") respect your privacy and are committed to protecting it by complying with this policy.

This policy describes:

  • The types of information we may collect or that users ("you") may provide when you purchase, register for, access, or use the DepartRight™ platform or other associated Company services (collectively, the "Platform"); and

  • Our practices for collecting, using, maintaining, protecting, and disclosing that information.

We will only use your personal information in accordance with this policy unless otherwise required by applicable law. We take steps to ensure that the personal information that we collect about you is adequate, relevant, not excessive, and used for limited purposes.

Privacy laws in Canada generally define "personal information" as any information about an identifiable individual, which includes information that can be used on its own or with other information to identify, contact, or locate a single person. Personal information does not include business contact information, including your name, title, or business contact information.

This policy applies to information we collect through the Platform and in email, text, and other electronic communications sent through or in connection with the Platform.

This policy does not apply to information collected by websites, applications, or services operated by third parties, except where those third parties process personal information on our behalf as service providers.

Please read this policy carefully to understand our policies and practices for collecting, processing, and storing your information. If you do not agree with our policies and practices, do not download, register with, or use this Platform. By downloading, registering with, or using this Platform, you indicate that you understand, accept, and consent to the practices described in this privacy policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of this Platform after we make changes indicates that you accept and consent to those changes, so please check the policy periodically for updates. 

INFORMATION WE COLLECT ABOUT YOU AND HOW WE COLLECT IT

We collect information about you through:

  • Direct interactions with you when you provide it to us, for example, by filling in forms or corresponding with us. 

  • Automated technologies or interactions, when you use the Platform, for example, usage details, IP addresses, log-in information, and information collected through cookies or similar technologies that are necessary or useful for operating, securing, and improving the Platform.

The types of information that we collect include:

  • Personal information that we can reasonably use to directly or indirectly identify you, such as your name, mailing address, email address, telephone number, internet protocol (IP) address, user name or other similar identifier, billing and account information, and any other identifier we may use to contact you ("personal information").

  • Non-personal information that does not directly or indirectly reveal your identity or directly relate to an identified individual, such as, demographic information, or statistical or aggregated information. We may derive non-personal statistical or aggregated data from personal information. For example, we may aggregate personal information to calculate the percentage of users accessing a specific app feature.

  • Technical information, including your login information, device type, time zone setting, and usage details.

  • Vault content, including photos, documents, files, written notes, and other information that you choose to upload to your password-protected vault. Vault content may include sensitive personal information about you or other individuals, depending on what you choose to upload.

INFORMATION YOU PROVIDE TO US 

When you download, register with, or use this Platform, we may ask you to provide:

  • Information by filling in forms in the Platform. This includes information you provide when registering to use the Platform, subscribing to our service, posting material, and/or requesting further services. We may also ask you for information if/when you report a problem with the Platform.

  • Records and copies of your correspondence, including email addresses and phone numbers, if you contact us.

  • Your responses to surveys that we might ask you to complete for research or other purposes.

  • Details of transactions you carry out through the Platform and order fulfillment. We may collect billing and payment-related information required to process your subscription or purchase, but we do not collect or store bank account numbers or bank account balances.

  • Your search queries on the Platform.

AUTOMATIC INFORMATION COLLECTION AND TRACKING TECHNOLOGIES

When you access and use the Platform, it may automatically collect limited technical and usage information needed to operate, secure, maintain, and improve the Platform.

  • Usage details. When you access and use the Platform, we may automatically collect certain details of your access to and use of the Platform, including traffic data, logs, authentication events, and information about the resources that you access and use on or through the Platform.

  • Device information. We may collect information about your device and internet connection, including IP address, operating system, browser type, and similar technical information.

The technologies we use for this automatic data collection may include:

  • Cookies. A cookie is a small file placed on your device. Cookies may be used to support account authentication, security, user preferences, and Platform functionality. You may be able to refuse cookies by activating the appropriate browser setting, but if you do so some parts of the Platform may not function properly.

  • Web beacons or similar technologies. Pages of the Platform and our emails may contain small electronic files that permit us, for example, to count users who have visited those pages or opened an email and to verify system and server integrity.

The information we collect automatically may include personal information. We use this information to maintain, protect, troubleshoot, and improve the Platform, including by helping us to:

  • Estimate our audience size and usage patterns.

  • Store information about your preferences and customize our Platform according to your individual interests.

  • Recognize you when you use the Platform.

HOW WE USE YOUR INFORMATION

We may use information that we collect about you or that you provide to us, including any personal information:

  • To provide you, your executor, family member, or any other person to whom you provide access credentials or a key code (collectively, the "Authorized Users") with access to the Platform and the vault content you choose to make available to them.

  • To provide you or your Authorized Users with information, products or services that you request from us.

  • To fulfill the purposes for which you provided it or that were described when it was collected or any other purpose for which you provide it.

  • To provide notices about your account or subscription, including expiration and renewal notices.

  • To carry out our obligations and enforce our rights in any contracts with you, including for billing and collection or to comply with legal requirements.

  • To notify you when Platform updates are available, and of changes to any products or services we offer or provide though it.

  • To improve our Platform, products or services, or customer relationships and experiences.

  • To send you service-related communications and, where permitted by law and with any required consent, promotional communications about our own products or services.

  • To allow you or your Authorized Users to participate in interactive features on our Platform.

  • For any other purpose with your consent.

Usage information that we collect helps us to improve our Platform and to deliver a better and more personalized experience, including by enabling us to:

  • Estimate our audience size and usage patterns.

  • Store information about your preferences, allowing us to customize our Platform according to your individual interests.

  • Speed up your searches.

  • Recognize you when you use the Platform.

DISCLOSURE OF YOUR INFORMATION

We will not sell, rent, or otherwise disclose your personal information or vault content to third parties for their own marketing or unrelated purposes. We may disclose personal information only as follows:

  • To your Authorized Users, in accordance with the access credentials, key code, permissions, and instructions associated with your account;

  • To fulfill the purpose for which you provide it;

  • With your consent;

  • Where required to by – and only to the extent strictly necessary by - any applicable law, regulation, or court order; or

  • To contractors, service providers, and other third parties we use to support the Platform, including cloud hosting, storage, security, authentication, payment processing, maintenance, customer support, and analytics providers. We contractually require these third parties to protect personal information, use it only for the purposes for which we disclose it, and process personal information following standards consistent with this policy and applicable privacy laws.

TRANSFERRING YOUR PERSONAL INFORMATION

We may transfer personal information that we collect or that you provide to contractors, service providers, and other third parties we use to support the Platform, including cloud hosting, storage, security, authentication, payment processing, maintenance, customer support, and analytics providers, who are contractually obligated to keep personal information confidential, use it only for the purposes for which we disclose it to them, and process the personal information with standards consistent with this policy and applicable privacy laws.

The Platform stores vault content and related account information using cloud infrastructure, currently including AWS secure cloud storage. Your personal information may be processed, stored, or transferred in Canada or in other countries where we or our service providers operate. In those circumstances, the laws of those countries may permit governments, courts, law enforcement, or regulatory agencies to access your personal information. Whenever we engage a service provider, we require that its privacy and security standards comply with this policy and applicable Canadian privacy laws.

By submitting your personal information or using the Platform, you acknowledge that your personal information may be transferred, stored, or processed as described in this policy.

CHOICES ABOUT HOW WE USE AND DISCLOSE YOUR INFORMATION

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information: 

  • Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the Platform may not be accessible or may not function properly. For more information about tracking technologies, see Automatic Information Collection and Tracking Technologies.

  • Promotional Offers from the Company. If you have opted in to receive promotional emails from us but no longer wish for us to use your contact information to promote our own products or services, you can opt out by emailing admin@departright.com or by using any unsubscribe mechanism included in the promotional email. This opt-out does not apply to service-related communications, including account, subscription, security, maintenance, or transactional notices.

DATA SECURITY

The security of your personal information is very important to us. We use physical, electronic, and administrative measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. 

The safety and security of your information also depends on you. Where we have given you (or you have chosen) a password for access to certain parts of our Platform, you are responsible for keeping it confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Platform like message boards, which any Website visitor can view.

Your vault is designed to be password protected and to use multi-factor authentication. You are responsible for safeguarding your password, key code, and any other credentials and for deciding who may access your vault. If you share your credentials or key code, or if an Authorized User downloads, copies, shares, or otherwise handles vault content outside the Platform, we may no longer be able to control or protect that information.

Unfortunately, the transmission and storage of information through the Internet and cloud-based platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of personal information transmitted through or stored on the Platform. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any Platform privacy settings or security measures.

DATA RETENTION

Except as otherwise permitted or required by applicable law or regulation, we will only retain your personal information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Under some circumstances we may anonymize or aggregate your personal information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent. 

If you delete vault content or other information from the Platform, we may not be able to retrieve it. Residual copies may remain for a limited period in backup, disaster recovery, audit, security, or legal compliance systems, but we will not use those residual copies for any other purpose.

CHILDREN UNDER THE AGE OF 13

Our Platform is not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Platform. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on this Platform or on or through any of its features/register on the Platform, make any purchases through the Platform, use any of the interactive or public comment features of this Platform, or provide any information about yourself to us, including your name, address, telephone number, email address, or any user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us at admin@departright.com.

ACCESSING AND CORRECTING YOUR PERSONAL INFORMATION

It is important that the personal information we hold about you is accurate and current. Please keep us informed if your personal information changes. By law you have the right to request access to and to correct the personal information that we hold about you.

If you want to review, verify, correct, or withdraw consent to the use of your personal information you may send us an email at admin@departright.com to request access to, correct, or delete any personal information that you have provided to us. We may not be able to delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

We may request specific information from you to help us confirm your identity and your right to access, and to provide you with the personal information that we hold about you or make your requested changes. Applicable law may allow or require us to refuse to provide you with access to some or all of the personal information that we hold about you, or we may have destroyed, erased, or made your personal information anonymous in accordance with our record retention obligations and practices. If we cannot provide you with access to your personal information, we will inform you of the reasons why, subject to any legal or regulatory restrictions.

We will provide access to your personal information, subject to exceptions set out in applicable privacy legislation. Examples of such exceptions include:

  • Information protected by solicitor-client privilege.

  • Information that is part of a formal dispute resolution process.

  • Information that is about another individual that would reveal their personal information or confidential commercial information.

  • Information that is prohibitively expensive to provide.

If you or an Authorized User downloads, copies, shares, or otherwise handles vault content outside the Platform, we may no longer be able to control, retrieve, delete, or protect that information.

WITHDRAWING YOUR CONSENT

Where you have provided your consent to the collection, use, and transfer of your personal information, you may have the legal right to withdraw your consent under certain circumstances. To withdraw your consent, if applicable, contact us at admin@departright.com. Please note that if you withdraw your consent, we may not be able to provide you with a particular product or service. We will explain the impact to you at the time to help you make your decision. 

Because vault content may include sensitive information about you or other individuals, you should only upload information that you are authorized to provide and should only grant access to persons you trust. You are responsible for ensuring that you have any required authority or consent to upload personal information about another individual.

CHANGES TO OUR PRIVACY POLICY

We may update our privacy policy from time to time. It is our policy to post any changes we make to our privacy policy on this page. If we make material changes to how we treat our users' personal information, we will post the new privacy policy on this page. 

We include the date the privacy policy was last revised at the top of the page. You are responsible for ensuring we have an up-to-date, active, and deliverable email address for you, and for periodically visiting this privacy policy to check for any changes.
